Duby Promise of Privacy
At Duby, we understand your privacy concerns regarding applications or activities that involve products and discussions that are medically and legally available in many, but not all of the states in the United States of America. We are witnessing a change in our culture that will take time and tolerance. For that reason one’s privacy remains a higher priority in certain cultures and the applications that serve them. We at Duby make you a promise to take every precaution reasonable and feasible to secure the information you provide us and maintain your anonymity by default. Any information you provide us, in any and all forms that is outside of the minimum amount of information required to collect by law or as a requirement of service (see User Provided Information, below), shall be reasonably protected from unauthorized access or dissemination.
What information does the Application obtain and how is it used?
User Provided Information
The Application obtains the information you provide when you download and register the Application. Registration with us is optional. However, please keep in mind that you may not be able to use some of the features offered by the Application unless you register with us. We only require the collection of information that not personally identifiable in part or whole during the registration process. All other information that could be uniquely identifiable to an individual remains optional during and after registration.
A user’s exact geographic location will be obfuscated to regional areas in all publicly accessible displays.
When you register with us and use the Application, you generally provide (a) username, email address, age, and your location at the time of registration; (b) transaction-related information, such as when you make purchases, respond to any offers, or download or use applications from us; (c) information you provide us when you contact us for help; (d) credit card information for purchase and use of the Application itself, services provide within the application, and in-app purchases, and; (e) information you enter into our system when using the Application, such as general contact information.
We may also use the information you provided us to contact your from time to time to provide you with important information, required notices and marketing promotions. You may opt out or unsubscribe from these notices at any time.
Automatically Collected Information
In addition, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device or computer, your operating system type and version, the type of Internet browsers you use, and information about the way you use the Application in order to collect data that will be used to develop better user experiences. If data are used for any other purpose outside of the internal use of Duby, LLC, the data will be made anonymous prior to any activity considered external to the company or public in nature.
Does the Application collect precise real time location information of the device?
When you visit the mobile application, we may use GPS technology (or other similar technology) to determine your current location in order to determine the city you are located within and display a location map of your registered location and the location of your device at the time a message is sent through the Application. We will not share your exact location with other users of the Application. Only your generic “rough” location, (ex. city, zip, or geographical area) will be displayed to other users and in publicly available reports and message map views.
If you do not want us to use your location for the purposes set forth above, you should turn off the location services for the mobile application located in your account settings or in your mobile phone settings and/or within the mobile application. However, the Application relies on location services to distribute messages to nearby users and validate that a device remains within the user’s registered location based on laws that may prevent the legal, ethical, or moral use of the Application. Use of the Application with GPS services disabled may disable key features within the application and is not recommended. We know battery life is important and will strive to maintain an efficient algorithm that reduces GPS usage to the minimum necessary to perform as expected.
Do third parties see and/or have access to information obtained by the Application?
Yes. We will share your information with third parties only in the ways that are described in this privacy statement.
We may disclose User Provided and Automatically Collected Information:
- as required by third party service providers, in which software components are used in part, or in full to provide additional functionality.
- as required by law, such as to comply with a subpoena, or similar legal process;
- when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
- with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.
- if Duby, LLC is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of this information, as well as any choices you may have regarding this information.
Notwithstanding anything else in this policy, we may work with partners who use mobile SDKs, including the OneSignal Messaging SDK, to passively collect information (collectively, “SDK Information”), which generally helps us deliver personalized notifications. This data may also be used to identify you in a unique manner across other devices or browsers for the purposes of customizing ads or content. Depending on the permissions granted to this application, this information may include personally identifiable information (PII) including your e-mail address. This information may also include precise location (i.e. GPS-level data) or WiFi information, apps you have installed and enabled, and your mobile identifier (e.g., Android Advertising ID).
Consumer Control & Opt-Out Options
a. Opting-out of OneSignal Push Notifications
You may in most cases opt out of receiving push notifications by going to your device “Settings” and clicking on “Notifications,” and then changing those settings for some or all of the apps on your device. (Different device configurations, or updates to devices, may affect or change how these settings work.)
b. Opting Out of “Cross-App” Advertising on Mobile Devices
You can opt out of having your mobile advertising identifiers used for certain types of interest-based (also called “cross-app”) mobile behavioral advertising, by accessing the “settings” on your Apple or Android mobile device, as follows: By opening the Google Settings app on your device, selecting Ads, and then selecting the option to opt-out of interest-based ads. (Different device configurations, or updates to devices, may affect or change how these settings work.)
What are my opt-out rights?
You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. You can also request to opt-out via email, at firstname.lastname@example.org
Data Retention Policy, Managing Your Information
We will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. We will retain Automatically Collected information for up to seven years and thereafter may store it in aggregate. If you’d like us to delete User Provided Data that you have provided via the Application, please contact us at email@example.com and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the Application to function properly.
Children and Teens
We do not use the Application to knowingly solicit data from or market to children and teens under the age of 17. Our applications are rated 17+ and may be limited to geographical location. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at firstname.lastname@example.org. We will delete such information from our files within a reasonable time.
We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.
